European patent translation into Spanish: deadlines, requirements and validation in Spain
If the European Patent Office has just granted your patent and you want it to take effect in Spain, the short answer is this: a Spanish translation of the granted text must be submitted to the Spanish Patent and Trademark Office (SPTO) within three months from the publication of the mention of the grant in the European Patent Bulletin, extendable by two months if requested within that period. If the holder does not reside in Spain, the translation must be carried out by an Industrial Property Agent. Without it, the patent has no effect in Spain.
The translation of European patents is not a minor formality: it turns a European grant into an enforceable right in Spain. In this article, we explain what to translate, in what order, which mistakes we see most frequently and how a specialized translation agency works alongside the patent agent.
What European patent validation in Spain is and why it depends on translation
The European patent is granted through a single procedure before the European Patent Office, but afterwards it becomes a bundle of national patents. Each designated State sets its requirements for it to take effect in its territory, and Spain requires the full translation into Spanish. This procedure is the European patent validation in Spain, and the European patents translation is its centerpiece.
The legal framework is in Law 24/2015, of July 24, on Patents, which regulates the effects in Spain of European patents. The SPTO itself details the procedure in its manual on the definitive protection of the European patent in Spain, which should be reviewed with the agent. Spain does not apply the London Agreement, which in other States reduces the obligation to translate, so here the patent translation is complete: description, claims and text of the drawings.
Does the unitary patent avoid the translation of European patents into Spanish?
Not in Spain. The patent with unitary effect managed by the European Patent Office only covers the participating States, and Spain is not part of the system. Although a company may obtain unitary effect in a large part of Europe, to protect its invention in Spain it must validate it through the national route with the corresponding European patent translation.
Deadlines and steps for translation before the SPTO
The schedule is what generates the most pressure. The three months count from the publication of the mention of grant in the European Patent Bulletin, not from when the company receives the notification from the agent. Therefore, the translation before the SPTO should start before the grant is published, and European patent translation needs its own schedule within the file.
- Confirm the date of the mention of grant and calculate the due date with the agent.
- Obtain the granted text, which may differ from the published application.
- Translate the full text: description, claims and text of the figures.
- Review terminology with a second specialist and with previous family translations.
- Deliver the translation to the agent for its electronic filing and payment of the fee.
- Verify the publication in the Official Industrial Property Gazette (BOPI).
Phase What is translated Reference deadline Who is involved Published European application Claims only Voluntary, after the application is published Applicant, agent and translator Patent grant Full granted text 3 months from the mention (+2 with extension requested on time) Proprietor, agent and translator Amendment in opposition Amended text Confirm with the agent as applicable Proprietor, agent and translator
What happens if the translation is not submitted on time?
The patent does not take effect in Spain and the SPTO records this lack of translation in its registry. We recommend setting an internal delivery date with the agent with a margin of several weeks. The recovery routes must be analyzed with the agent or the attorney.
Who can sign the European patent translation?
If the proprietor does not reside in Spain, the SPTO requires the translation to be carried out by an Industrial Property Agent, who usually relies on apatent translatoror a specialized translation agency. For the validation, a sworn translation is not required; this appears in other contexts, such as judicial proceedings, and it is useful to know the difference between legal and sworn translation before ordering it. For those cases, there is our sworn translation service, where we have sworn translators from the Ministry of Foreign Affairs (MAEC) which, together with our experience of more than 10 years, allows us to offer a quality service that ensures your procedures are carried out with the highest guarantees.
Translation of claims: the part that defines the scope of protection
The claims determine what the patent protects. A nuance in a single word can broaden or narrow that scope, and in Spain the translated text has its own legal consequences against third parties. Therefore, within the European patent translation, the translation of claims always receives a second specialized review.
The law also allows provisional protection to be obtained before the grant by submitting the translation of the claims of the published application, as detailed in the SPTO manual on provisional protection. The agent assesses this option depending on the risk of infringement in Spain
| Original expression (EN) | Common translation | Why it matters |
| comprising | que comprende | Open claim: allows additional elements. |
| consisting of | que consiste en | Closed claim: excludes other elements. |
| characterised in that | caracterizado por que | Separates the prior art from the novel part. |
| substantially | sustancialmente | Removing it may restrict the scope. |
| means for | medios para | Defines an element by its function, not by its structure. |
Confusing ‘comprising’ with ‘consisting of’ shows why the technical language of a patent does not allow free synonyms.
What we review before quoting a European patent translation
Each European patent translation order starts with a review of the file, not with a word count. These are the points of our first consultation and the problems we see most often with agents and R&D departments.
What documentation is usually missing?
- The granted text (B1, or B2 if amended in opposition); we often receive the A1 application.
- The figures in a legible format, because their texts are also translated
- The exact publication date of the mention of grant.
- Previous translations of the patent family or a client glossary.
What circumstances complicate the order?
Chemistry, pharmacy and biotechnology patents, containing formulas and sequences; German or French originals with extensive claims; and portfolios with simultaneous deadlines. In these cases, we assign professionals with scientific backgrounds from our scientific translation services.
Common mistakes in European patent translation
- Translating the published application instead of the granted text.
- Using different terms for the same element in the description and the claims.
- Omitting text in figures or altering reference numbers.
- Deliver machine translation without review to save time.
When is it not advisable to translate yet?
If Spain is not yet a decided market, that decision goes first. It is also not advisable to translate the full text from the published application with the examination open: the efficient approach is to wait for the communication of intention to grant (Rule 71(3) of the European Patent Convention), whose text is already practically definitive and allows advancing the translation of European patents by several weeks.
Situación Qué traducir Momento recomendado Published application with risk of infringement in Spain Claims only After the publication of the application Intention to grant received Intended full text With the communication of the Rule 71(3) Grant published without translation started Full text, with priority Immediately; assess the extension
Typical case: a medical equipment company with a German patent of eighteen claims starting with Rule 71(3) reaches the deadline with room for two revisions; if it waits for the grant, everything is compressed into a few weeks.
How a patent translator works in a specialized agency
A patent translator combines two skills that rarely go together: mastery of the invention’s technical field and of the formal language of patents. At Translinguo Global, we review both layers separately so that the agent receives a European patent translation ready to file.
We work in Phrase with translation memories and glossaries per client, which ensures terminology standardization between patents from the same portfolio. The workflow follows the ISO 17100 standard, with separate translator and reviser, and AI is only applied with human post-editing in accordance with ISO 18587, never as a final delivery. For unpublished applications we apply non-disclosure agreements and the protocols of our confidential translation.
| Option | Advantage | Validation risk |
| Generalist translator | Low initial cost | Mistakes in the scope of the claims |
| Machine translation without revision | Speed | Terminological inconsistencies and ambiguous phrases |
| Agency with patent translator and technical reviser | Verifiable quality and traceability | Requires having the granted text on time |
How much does European patent translation cost and how long does it take?
It depends on the length, the technical field, the source language and the margin until the deadline, so we do not provide rates without seeing the text: we send a translation quote within 24 hours with a committed delivery deadline. If the patent is part of a license or assignment, our translations for international companies also cover the translation of international contracts and, if the transaction goes through a notary, the legalization of deeds.
Protecting an invention in Spain begins with its translation
A European patent protects nothing in Spain until its translation reaches the SPTO, and that translation sets, word for word, the scope of the right. The companies that best manage European patent translation prepare it before the grant, not after.
If you have a recent grant or a communication of intention to grant, request a quote and we will get back to you in less than 24 hours.
